NM Court of Appeals Schedules July 24, 1:30 PM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Tuesday, July 24, 2018. The oral argument is open to the public and begins at 1:30 P.M.
A three-judge panel will preside: Judge Linda M. Vanzi (’95), Judge Michael E. Vigil, and Judge Jennifer Attrep.
Following are the details of the case:
SAIPAN INVESTMENT GROUP, LLC, A NORTHERN MARIANA ISLANDS LIMITED LIABILITY COMPANY, Plaintiff-Appellee, represented by Thomas D. Walker
v.
GULFSTREAM LOMAS, LTD, A FLORIDA LIMITED PARTNERSHIP, Defendant-Appellant, represented by Bill Chappell, Jr. and James B. Boone
Wells Fargo Bank National Association as Trustee for the Registered Holders of Morgan Stanley Capital I Trust, Commercial Mortgage Passthrough Certificates, Series 2005-HQ5 an action for unpaid debt and foreclosure against Defendant-Appellee concerning a commercial building. Wells Fargo Bank did not proceed in its foreclosure action and instead sold the note at an auction. Thereafter, Plaintiff-Appellee filed a Motion for Order Substituting Saipan Investment, Group, LLC as Plaintiff. The court entered an order substituting Appellee as Plaintiff and an order appointing Appellee as receiver. Defendant-Appellant argues that the orders permitting substitution of Appellee as Plaintiff and order appointing Appellee as receiver are final orders and appeals.
