NM Court of Appeals Schedules June 19, 1:30 PM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Tuesday, June 19, 2018. The oral argument is open to the public and begins at 1:30 P.M.
A three-judge panel will preside: Judge J. Miles Hanisee , Judge Julie J. Vargas (’93), and Judge Emil J. Kiehne
Following are the details of the case:

v.
NMMI ALUMNI ASSOCIATION, INC., A NEW MEXICO NON-PROFIT CORPORATION, Defendant-Appellant, represented by Jeffrey A. Dahl
Plaintiff-Appellee filed a law suit against the Defendant-Appellant, alleging that the Defendant-Appellant had violated certain portions of the Memorandums of Agreement between the parties, and requesting injunctive relief. Plaintiff-Appellant claimed that it was terminating the MOA and its relationship with Defendant-Appellant, that Defendant-Appellant, as its agent, held all of its funds for the benefit of Plaintiff-Appellee, and that the Defendant-Appellant was no longer able to retain those funds because Plaintiff-Appellee had terminated the MOA. Plaintiff-Appellee sought a receivership; a constructive trust, a mandatory injunction and an accounting. The district court entered a judgment for the Plaintiff-Appellant.
