NM Court of Appeals Schedules Wednesday, May 3, 2017 10:00 A.M. Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Wednesday, May 3, 2017. The oral argument is open to the public and begins at 10:00 A.M.
A three-judge panel will preside: Judge Jonathan B. Sutin (’63), Judge M. Monica Zamora (’87), and Judge J. Miles Hanisee.
Following are the details of the case:
THE ELDORADO AREA WATER AND SANITATION DISTRICT, a governmental subdivision of the State of New Mexico, Plaintiff-Appellee, represented by Charles T. Dumars and Tanya L. Scott
vs.
THE JOSEPH AND ALMA MILLER REVOCABLE TRUST, Defendant-Appellant, represented by Ronald J. VanAmberg
This appeal arises from the efforts of the Appellee to locate an electric easement across Appellant’s property and Appellant’s efforts to develop three subdivisions to be served by a well managed by Appellee and powered by PNM via the easement. Appellant requests review of findings of the District Court in favor of Appellee’s complaint and against Appellant on the counts of the counterclaim.
