NM Court of Appeals to Hear Oral Arguments in Moot Courtroom

The New Mexico Court of Appeals has scheduled a hearing at the UNM School of Law at 2 p.m. Nov. 17 in the moot courtroom. The oral argument is open to the public.

A three-judge panel will preside: Chief Judge Cynthia A. Fry (`81), Judge Jonathan Sutin (`63), and Judge Celia Foy Castillo (`81).

Following are details for the cases:

Susan Bishop, et al., Plaintiffs-Appellants, represented by Eric Sedillo Jeffries and Brian A. Thomas (`97).

vs.

Evangelical Lutheran Good Samaritan Society, a Foreign Corporation d/b/a/ Manzano Del Sol Good Samaritan Village., Defendant-Cross Appellant, represented Martha G. Brown, Dan Conley and Paul Bauer

Plaintiffs-Appellants seek a reassessment of damages arising out of a claim of unlawful fee increases under the New Mexico Continuing Care Act (CCA). Defendant-Cross Appellant appeals the trial court’s finding for the plaintiff, on the grounds that the CCA’s provision allowing a limit on fees to a “reasonable return on investment” should be found unconstitutional for vagueness.
