NM Court of Appeals Schedules June 25, 10:00 AM Hearing

COA LogoThe New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Thursday, June 25, 2015. The oral argument is open to the public and begins at 10:00 A.M.

A three-judge panel will preside: Judge Michael D. Bustamante (’74), Judge Jonathan B. Sutin (’63), and Judge Timothy L. Garcia (’84)

Following are the details of the case:

The Court states, “Please focus your arguments on the following two issues:

  1. NMSA 1978, Section 31-27-6(E)(2) requires that a conviction precede forfeiture. Does this requirement implicate the double jeopardy clause when a forfeiture precedes conviction?
  2. What test should the Court employ in determining whether a proceeding is a single, bifurcated proceeding under State v. Nunez, 2000-NMSC-0l 3, 129 N.M. 63, 2 P.3d 264? See, e.g., State v. Esparza, 2003-NMCA-075, ¶ 27-28, 34, 133 N.M. 772,70 P.3d 762; In re P.S., 661 N.E.2d 329, 343 (Ill. 1996) cert. granted, judgment vacated sub nom. Illinois v. Kimery, 518 U.S. 1031 (1996); Oakes v. United States, 872 F. Supp. 817, 824-25 (E.D. Wash. 1994) rev’d, 92 F.3d 1195 (9th Cir. 1996); cf. State v. Davis, 903 P.2d 940, 944 (Utah Ct. App. 1995) rev’d, 972 P.2d 388 (Utah 1998).”
