NM Court of Appeals Schedules June 21 Hearings

The New Mexico Court of Appeals has scheduled hearings at the Pamela B. Minzner Law Center on June 21. The first oral argument begins at 10:30 a.m. and the second argument will begin at 1:30 p.m. Both hearings are open to the public.

At the 10:30 a.m. hearing, a three-judge panel will preside: Judge Jonathan B. Sutin (`63), Judge Roderick Kennedy, and Judge Linda M. Vanzi (’95).

Following are the details of the case:

Sunnyland Farms, Inc., Ohio Casualty Insurance Company and West American Insurance Company, Members of the Ohio Casualty Group of Insurance Companies, plaintiffs-appellees and cross-appellant, represented by Joseph Goldberg

vs.

Central New Mexico Electric Cooperative, Inc., defendant-appellant and cross-appellee, represented by Stephan S. Hamilton.

Appellee, Sunnyland Farms, states that Central New Mexico Electric Cooperative wrongfully turned off the electricity to their property, so that when a fire occurred there was no power to operate the hoses or water pumps. Appellant challenges damages award.

Robert Armijo, cross-claim plaintiff-appellee, represented by Tibo Chavez (`81)

vs.

Pueblo of Laguna, defendant-appellant, represented by Daniel I.S.J. Rey-Bear

The appellant challenges the trial court’s decision that it had the jurisdiction to decide a land ownership claim between a federally recognized tribe and a non-Indian claimant with regards to non-reservation land.
