NM Court of Appeals Schedules April 25, 2017 1:30 PM Hearing

April 5, 2017 - Jen Laws

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Tuesday, April 25, 2017. The oral argument is open to the public and begins at 1:30 P.M.

A three-judge panel will preside: Chief Judge Linda M. Vanzi (’95), Judge Michael E. Vigil, and Judge M. Monica Zamora (’87).

Following are the details of the case:

GLORIA MENDOZA, Worker-Appellant, represented by LeeAnn Ortiz

vs.

ISLETA RESORT AND CASINO, and HUDSON INSURANCE, Employer/Insurer-Appellees, represented by Christina S. West and Justin J. Solimon

and

TRIBAL FIRST, Appellee,

and

STATE OF NEW MEXICO UNINSURED EMPLOYERS’ FUND, Statutory Third Party, represented by Richard Bustamante

This is an appeal from a Workers’ Compensation Order Granting Employer/Insurer’s Motion to Dismiss based on lack of subject matter jurisdiction. The case arose after Gloria Mendoza was injured while working as a custodial porter at Isleta Resort and Casino in 2015. When Ms. Mendoza filed her Workers’ Compensation Complaint, there was some confusion about what company was the insurer of Isleta Resort and Casino; this confusion persisted throughout the case.
