NM Court of Appeals Schedules July 27 Hearings

The New Mexico Court of Appeals has scheduled two hearings on July 27 at the Pamela B. Minzner Law Center. The first oral argument begins at 10 a.m. The second hearing begins at 1:30 p.m. Both are open to the public.

Details for the 10 a.m. hearing are as follows:

A three-judge panel will preside: Chief Judge Cynthia A. Fry (’81), Judge James J. Wechsler and Judge Michael D. Bustamante (’74)

Following are the details of the case:

Edwin Gurule, individually and as personal representative for the Estate of Sammy Gurule, deceased, Plaintiff-Appellee/Cross-Appellant, represented by William H. Lazar, Gilbert Arrazolo, James B. Ragan

vs.

Ford Motor Company, Defendant-Appellant/Cross-Appellee, represented by Edward Ricco (`80), Jocelyn Drennan (`97), Jeffrey M Croasdell (`93), Robert W. Powell

Defendant-Appellant seeks either judgment as a matter of law, or a new trial, based on the claim that the plaintiff-appellee’s expert witness’s testimony did not sufficiently support a finding for the plaintiff’s theory of causation.

Following are the details of the case:

Kristopher May, Plaintiff-Appellant, represented by Caren L. Friedman (`94), James L. Killion, Samantha Peabody Estrello

vs.

DCP Midstream, L.P., f/k/a Duke Energy Field Services L.P., and Duke Energy Field Services Inc., Defendants-Appellees, represented by Richard E. Olson, Lucas M. Williams

Plaintiff-appellant claims that summary judgment for the defendant was not appropriate, as there were issues of material fact with regards to whether the defendants’ conduct allowed for a cause of action outside the Worker’s Compensation Act.
