NM Court of Appeals Schedules August 17 Hearings

The New Mexico Court of Appeals has scheduled a hearing for 10 a.m. August 17 at the Pamela B. Minzner Law. The oral argument is open to the public.

A three-judge panel will preside: Judge Michael E. Vigil, Judge Linda M. Vanzi (&#8217 ;95) and Judge Timothy L. Garcia (’84).

Following are the details of the case:

O’Brien and Associates, Inc, Petitioner-Appellee,

vs.

Carl Kelley Construction Ltd. Co., a New Mexico Limited Liability Company, Behles Law Firm, P.C., a New Mexico Professional Corporation, Ron Miller, CPA, a New Mexico Professional Corporation and Stephanie O’Brien and Del Rio Corporation, &#160 ;Respondents-Defendants-Appellees, represented by Jennie D. Behles (`70).

and

Lubbock National Bank, a Texas Banking Corporation, Respondent-Defendant-Appellant, represented by Emily Frank (`85), Alan P. Morel, Lee Griffin.

Respondent-defendant-appellant seeks a reversal of the trial court’s finding that their mortgage to the petitioner-appellee was void because it lacked consideration. Respondents-defendants-appellees counter that they are the only defendants with a legitimate interest in the parcel of the land at the center of the case.
