NM Court of Appeals Schedules January 23, 10:00 AM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Tuesday, January 23, 2018. The oral argument is open to the public and begins at 10:00 A.M.
A three-judge panel will preside: Judge M. Monica Zamora (’87), Judge J. Miles Hanisee, and Judge Julie J. Vargas (’93).
Following are the details of the case:

SRT-MOUNTAIN VISTA LLC, AND ROBERT FOX AND LINDA FOX, Respondents, represented by Frank C. Salazar, Larry Curtis Vernon, and Claud Eugene Vance
This case involves the Petitioner-Appellant's petitions for writ of certiorari in two matters decided by the Bernalillo County Valuation Protests Board ("Board"). The two cases are valuation protests by property owners SRT-Mountain Vista, LLC, and Robert and Linda Fox. The district court entered an order certifying the matter to the Court of Appeals. The order specifically noted that the district court had not yet issued a writ of certiorari, that it had not ruled on the merits of the petition, and that it had not ruled on the amended motion to dismiss. All three hearings concerned two principle issues: 1) whether the district court had jurisdiction over the petition for writ of certiorari; and 2) whether the Board had erred in its application of the relevant statute governing the valuations at issue.
