NM Court of Appeals Schedules September 18, 10:00 AM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Monday, September 18, 2017. The oral argument is open to the public and begins at 10:00 A.M.
A three-judge panel will preside: Judge J. Miles Hanisee, Judge Julie J. Vargas (’93), and Judge Stephen G. French.

GANDYDANCER, LLC, Plaintiff-Appellee, represented by Robert N. Singer and Addison K. Adams
v.
ROCK HOUSE CGM, LLC, and KARL G. PERGOLA, Defendants-Appellants, represented by Michael P. Clemens, Rodney L. Schlagel, and Rheba Rutkowski
Plaintiff-Appellee brought suit against Defendants-Appellants seeking damages, injunctive relief, and attorneys’ fees related to a business dispute involving railroad-contracting services for BNSF Railway. Plaintiff-Appellee sought damages suffered as a result of Defendants’ alleged violations of the New Mexico Unfair Practices Act (UPA). The issue raised in this interlocutory appear is whether Plaintiff-Appellee has standing to assert a claim for damages under the UPA.
