NM Court of Appeals Schedules February 13 Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Monday, February 13, 2012.

The oral argument is open to the public and begins at 2:00 pm.

A three-judge panel will preside: Chief Judge Celia Foy Castillo (’81), Judge Cynthia A. Fry (’81), and Judge Roderick Kennedy.

Following are the details of the case:

LISA NASS-ROMERO, on behalf of , herself and all others similarly situated, Plaintiff-Appellant, represented by Shane C. Youtz, Jonathan W. Cuneo, Daniel Cohen, Gordon Ball and George Samson

vs.

VISA U.S.A., INC., and MASTERCARD INTERNATIONAL, INC.,  Defendants-Appellees represented by Jerry Todd Wertheim, Kenneth A. Gallo, Gary R. Carney, Leslie McCarthy Apodaca and Robert C. Mason.

Plaintiff-Appellant state that the fees charged to merchants for processing debit card purchases are excessive and result in an increase in prices for consumers, that the ability to charge such fees is a product of the Defendants-Appellees control of the market, and that, contrary to the trial court’s findings, the injury to consumers is not too remote to be covered by New Mexico Antitrust Act and Unfair Practices Act.
