NM Court of Appeals Schedules September 20 Hearings

The New Mexico Court of Appeals has scheduled two hearings at the Pamela B. Minzner Law Center on Thursday, September 20, 2012.

The first oral argument is open to the public and begins at 10:00 am.

A three-judge panel will preside: Judge Michael D. Bustamante (’74), Judge Michael E. Vigil and Judge J. Miles Hanisee.

Following are the details of the case:

CARL UNDERWOOD, Petitioner-Appellant, represented by Pete V. Domenici, Jr., Lorraine Hollingsworth

vs.

NEW MEXICO COMMISSIONER OF PUBLIC LANDS, PATRICK LYONS, Respondent-Appellee represented by John L. Sullivan

Appellant contends that the compensation he received for improvements he made to land he had lease from the State Land Office  were inadequate and the procedure did not meet the requirements of Section 19-7-14 NMSA 1978.

The second oral argument is open to the public and begins at 1:30 pm.

A three-judge panel will preside: Judge Michael D. Bustamante (’74), Judge Cynthia A. Fry (’81) and Judge Michael E. Vigil.

Following are the details of the case:

DAN LOPER d/b/a RIO LECHE DAIRY, CO., Plaintiff-Appellant, represented by Felicia C. Weingartner, David A. Domina

vs.

JMAR, a New Mexico general, Defendant-Appellee represented by Gregory L. Biehler

Appellant challenges the exclusion of his expert witness and the ruling that his settlement with a second defendant settled his claim against the Appellee.
