NM Court of Appeals Schedules April 21 Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Court of Appeals Pamela B. Minzner Law Center at 10:00 a.m. April 21. The oral argument is open to the public.

Presiding will be Judge Roderick Kennedy, Judge Michael Vigil (`77) and Judge Linda Vanzi (`95).

Following are the details of the case:

Plaintiffs-Appellants appeal the ruling of the trial court that the “going and coming” rule found in the Workers’ Compensation Act, NMSA 1978, § 52-1-19, preempts a negligence claim against the New Mexico Department of Transportation for injuries incurred due to a fall in their parking lot by a state employee from the Department of Public Safety.
