State Court of Appeals Sets Hearing on Jan. 26

The New Mexico Court of Appeals has scheduled a hearing at 10 a.m. Jan. 26 in the Court of Appeals Pamela B. Minzner Law Center. The oral argument is open to the public.
A three-judge panel will preside: Chief Judge Cynthia A. Fry (`81), Judge Jonathan Sutin (`63) and Judge Robert E. Robles (`75).
Following are the details of the case:
Arena Resources, Inc., plaintiff-appellee, represented by Brian Matthew Catalano and Susan Richardson
vs.
OBO Inc., defendant-appellant, represented by Mark Terence Sanchez
Defendant- appellant contends that the trial court deprived the defendant-appellant of their rights and protections under the contract between defendant-appellant and plaintiff-appellee and exceeded its authority when it awarded the plaintiff-appellee under the theory of unjust enrichment when the issue has not been pleaded, argued or tried by either party.
