NM Court of Appeals Schedules August 24, 1:30 PM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Wednesday, August 24, 2016. The oral argument is open to the public and begins at 1:30 P.M.

A three-judge panel will preside: Judge Roderick Kennedy, Judge M. Monica Zamora (’87), and Judge Stephen G. French.

Following are the details of the case:

PHH MORTGAGE CORPORATION, Plaintiff-Appellee, represented by Eraina M. Edwards

vs.

LEIGH G. WEBB, aka L. GEOFFREY WEBB and PATRICIA GAY WEBB, Defendants-Appellants

and

CHARLES SCHWAB BANK, N.A., Defendant, represented by Eric N. Ortiz

This case involves foreclosure proceedings between Plaintiff-Appellee (“the Bank”) and Defendatnts-Appellants (“the Borrowers”). The Borrowers contend that the Bank did not establish it had standing to bring a foreclosure action against the Borrowers at the time it filed the Complaint because the Bank did not prove it was in possession of the subject note at the time and because it did not offer substantial evidence to the District Court that it had the right to enforcement of the subject note through either a proper indorsement or a transfer by negotiation.
