NM Court of Appeals Schedules September 20, 1:30 PM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Tuesday, September 20, 2016. The oral argument is open to the public and begins at 1:30 P.M.

A three-judge panel will preside: Judge James J. Wechsler, Judge Timothy L. Garcia (’84), and Judge J. Miles Hanisee.

Following are the details of the case:

THE REHABILITATION CENTER OF ALBUQUERQUE, LLC; CATHY CORREA; and SKILLED HEALTHCARE, LLC, Defendants-Appellants, represented by Ellen Thorne Skrak, Valerie Denton, and Jocelyn Drennan

Following an auto accident that left Plaintiff Harley John paraplegic and treatment at a hospital and two rehabilitation centers, Plaintiff John was transferred to a skilled nursing facility in October 2012, The Rehabilitation Center of Albuquerque, LLC. Three weeks after arrival John was asked to sign an Arbitration Agreement and did so. Plaintiffs filed suit against the State of New Mexico, New Mexico Department of Transportation, The Rehabilitation Center of Albuquerque, LLC, Cathy Correa, and Skilled Healthcare, LLC in August 2013 alleging that the Defendants were negligent in the case they provided to Plaintiff John. The Appellants request review of the district court’s order invalidating the Arbitration Agreement.
