NM Court of Appeals Schedules November 13, 10:00 AM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Monday, November 13, 2017. The oral argument is open to the public and begins at 10:00 A.M.

A three-judge panel will preside: Judge Michael E. Vigil, Judge Stephen G. French, and Judge Julie J. Vargas (’93).

Following are the details of the case:

STATE OF NEW MEXICO, Plaintiff-Appellee, represented by Hector H. Balderas and Walter Hart

v.

SHAROSKI BERNARD JACKSON, Defendant-Appellant, represented by Bennett J. Baur and B. Douglas Wood III

Defendant-Appellant directly appeals convictions for human trafficking, promoting prostitution, accepting earnings from a prostitute, contributing to the delinquency of a minor, and conspiracy. Defendant-Appellant contends that the district court erred in its instruction to the jury on human trafficking and maintains that the instruction should have required the jury to make a finding as to whether he knew the age of the alleged minor victim. Defendant-Appellant further contends that the district court erred in not granting a new trial on the basis of newly discovered evidence and also in admitting an exhibit containing text messages where a proper foundation was not laid as to who authored those texts.  Defendant-Appellant also seeks review on the sufficiency of the evidence supporting his convictions. On all these bases, Defendant-Appellant seeks reversal and, where appropriate, a new trial.
