NM Court of Appeals Schedules April 18 Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Thursday, April 18, 2013. The oral argument is open to the public and begins at 1:30 p.m.
A three-judge panel will preside: Chief Judge Roderick Kennedy, Judge Michael E. Vigil and Judge J. Miles Hanisee.

PONDEROSA PINES PROPERTY OWNERS ASSOCIATION, et al., Defendants-Appellees, represented by W.T. Martin, Jr.
Appellant states that: alleged verbal representations that appear in no legal document of record cannot bind and control the perpetual use of real property; disputed material facts precluded summary judgment to the appellee; appellee’s failure to serve all defendants with the motion for summary judgment was fatal to the motion; the district court erred in granting summary judgment and in taking judicial notice of a disputable personal assumption.
