NM Court of Appeals Schedules February 21, 3:00 PM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Tuesday, February 21, 2017. The oral argument is open to the public and begins at 3:00 P.M.
A three-judge panel will preside: Judge Linda M. Vanzi (’95), Judge James J. Wechsler, and Judge J. Miles Hanisee.

This is an appeal by Renzenberger, Inc. ("Taxpayer") from a decision of the district court granting summary judgment to the New Mexico Taxation and Revenue Department ("Department") and denying summary judgment to Taxpayer. That order of the district court dismissed Taxpayer's refund claim – a refund for which Taxpayer asserts it was entitled under NMSA 1978, § 7-9-55(A) (1993) and 49 U.S.C. § 14505 (1995), and recognized under New Mexico law.
