NM Court of Appeals Schedules June 20, 11:00 AM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Monday, June 20, 2016. The oral argument is open to the public and begins at 11:00 A.M.

A three-judge panel will preside: Judge Michael E. Vigil, Judge James J. Wechsler, and Judge Linda M. Vanzi (’95).

Following are the details of the case:

STATE OF NEW MEXICO, Plaintiff-Appellant, represented by Steven Johnston

BRADFORD JAMES, Defendant-Appellee, represented by Linda Helen Bennett

This case is the consolidated appeal of Ct. App. No. 33,312 (the State’s appeal from the District Court’s “Order Suppressing Evidence, Dismissing Case, Remanding to Magistrate Court For Enforcement of Judgment, and Releasing Bond”) and Ct. App. No. 33,701 (the Defendant’s appeal of the District Court’s “Order Denying Defendant’s Motion to Dismiss”). In 2012, Defendant was charged with aggravated driving under the influence, driving while license suspended or revoked, no insurance, and failure to maintain a traffic lane stemming from a traffic stop. The Appellant asserts that the District Court properly denied the Appellee’s Motion to Dismiss and that the traffic stop in 2012 was supported by reasonable suspicion.
