NM Court of Appeals Schedules, 10:00 AM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Wednesday, , 2014. The oral argument is open to the public and begins at 10:00 A.M.

A three-judge panel will preside: Judge Michael D. Bustamante (’74), Judge Jonathan B. Sutin (’63), and Judge Michael E. Vigil.

DEBRA GRIEGO, Petitioner-Appellant

NEW MEXICO DEPARTMENT OF WORKFORCE SOLUTIONS and NEW MEXICO DEPARTMENT OF FINANCE AND ADMINISTRATION, Respondents-Appellees, represented by Marshall J. Ray

INDIA HATCH, Petitioner-Appellee, represented by Joseph E. Caldwell

vs.

NEW MEXICO DEPARTMENT OF WORKFORCE SOLUTIONS and THE NEW MEXICO RACING COMMISSION, Respondents-Appellants, represented by Marshall J. Ray

Debra Griego, former Chief Financial Officer and Administrative Services Division Director for the New Mexico Department of Finance and Administration, appeals from the First Judicial District Court’s decision denying her unemployment insurance benefits.

The New Mexico Department of Workforce Solutions appeals from the Eighth Judicial District Court’s reversal of the Departments’ decision denying unemployment insurance benefits to India Hatch, former Executive Director of the New Mexico Racing Commission.

In both matters, denial of benefits depends on the definition of the former positions held as “major non-tenured policymaking or advisory” in nature.
