NM Court of Appeals Schedules April 23, 10:00 AM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Monday, April 23, 2018. The oral argument is open to the public and begins at 10:00 AM
A three-judge panel will preside: Judge J. Miles Hanisee, Judge Stephen G. French, and Judge Emil J. Kiehne.

This interlocutory appeal involves a question of defamation law in New Mexico involving Appellant's investigative report about the performance of Appellee's job duties. The issue presented in this appeal is whether the Appellee, a former City of Albuquerque independent Hearing Officer, appointed by the presiding judge of the Second Judicial District Court, is a public official, thus triggering the application of the actual malice standard.
