NM Court of Appeals Schedules October 17, 10:00 AM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Monday, October 17, 2016. The oral argument is open to the public and begins at 10:00 A.M.

A three-judge panel will preside: Judge Roderick Kennedy, Judge Linda M. Vanzi (’95), and Judge M. Monica Zamora (’87).

This case presents the question whether racetrack owners or operators (racetrack proprietors) that are granted exclusive permission by New Mexico to hold horse races can exclude a State-licensed horse trainer, owner, or jockey (licensees) arbitrarily and without the involvement of State authority or due process. Appellant Carrillo is a New Mexico horse trainer and owner, racing horses under licenses issue by the State of New Mexico. Over a period of approximately nine months, the proprietors of four of the five New Mexico racetracks banned him. The district court found that, as a matter of law, racetrack proprietors may exclude any person for any reason so long as the reason is not unlawful. Appellant requests review of the district court.
