NM Court of Appeals Hears Oral Arguments at Law School

The New Mexico Court of Appeals has scheduled two separate hearings at the UNM School of Law, on June 24 and June 30, in the moot courtroom. Both oral arguments are open to the public. The June 24 argument begins at 10 a.m. and the June 30 argument begins at 10:30 a.m.

At each session, a three-judge panel will preside.

Following are details for the cases:

At the June 24 argument, presiding will be Judge Jonathan Sutin, Judge James Wechsler and Judge Robert Robles.

The case to be heard:

LINDA JOYCE GARCIA, Petitioner-Appellee, represented by Linda Helen Bennett and Mary E. Chapelle

vs.

JERRY M. GARCIA, Respondent-Appellant, represented by Thomas C. Montoya

Appellant seeks reversal of an order granting Appellee monthly benefit payments of the community property portion of Appellant’s retirement benefits effective as of the date of retirement eligibility as opposed to the date of Appellant’s actual retirement.

At the June 30 argument, presiding will be Judge James Wechsler, Judge Jonathan Sutin, and Judge Roderick Kennedy.

Plaintiffs-Appellants seeks reversal of trial court ruling that, under the New Mexico Inspection of Public Records Act (IPRA), a law firm is required to disclose the name of the client on whose behalf it requests public records.
