NM Court of Appeals Schedules April 24, 1:30 PM Hearing

COA LogoThe New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Tuesday, April 24, 2018. The oral argument is open to the public and begins at 1:30 P.M.

A three-judge panel will preside: Judge Linda M. Vanzi (’95), Judge Michael E. Vigil, and Judge Emil J. Kiehne.

Following are the details of the case:

This case started as a residential foreclosure action filed by Jaguar Associated Group, LLC ("Jaguar") on August 19, 2009. Alternative Money Source, LLC was the original lender on the loan. The loan has been extinguished through settlement. This appeal only concerns Defendant-Appellant's counterclaims for violation of the Home Loan Protection Act ("HLPA") and "intentional and/or negligent spoliation.” This is an appeal by Defendant/Cross-Claimant/ Appellant Andres of the dismissal of his counterclaims granted by Second Judicial District. He also appeals the District Court's denial of his Motion to Amend Counterclaims to add additional Counterclaims and the District Court's discovery orders.
