NM Court of Appeals Schedules January 24, 10:30 AM Hearing

COA LogoThe New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Wednesday, January 24, 2018. The oral argument is open to the public and begins at 10:30 A.M.

A three-judge panel will preside: Judge Stephen G. French, Judge Henry Bohnhoff, and Judge Emil J. Kiehne.

Following are the details of the case:

STATE OF NEW MEXICO, Plaintiff-Appellant, represented by Hector H. Balderas and John J. Woykovsky

v.

NEHEMIAH G, Child-Appellee, represented by Bennett J. Baur and J.K. Theodosia Johnson

Child-Appellee was originally charged with five counts of first degree murder. The children’s court held a hearing to determine whether Child-Appelle was amenable to rehabilitation. If so, he would receive a juvenile disposition. After the evidentiary hearing, the trial court concluded that Child-Appellee had "not been found to be not amenable to treatment in available juvenile facilities." It then sentenced him as a juvenile, committing him to the custody of the Children, Youth, and Families Department ("CYFD") for just over two years. Plaintiff-Appellant is appealing the trial court's amenability determination.
