NM Court of Appeals Schedules Sept. 20 Hearing

The New Mexico Court of Appeals has scheduled a 2:30 p.m. hearing at the Pamela B. Minzner Law Center on Sept. 20. The oral argument is open to the public.

A three-judge panel will preside: Chief Judge Cynthia A. Fry (’81), Judge Michael D. Bustamante (’74), and Judge Michael E. Vigil.

Following are the details of the case:

Bobby Windham, Vickie K. Windham, plaintiffs-appellants, represented by David M. Houliston (`87) and Maureen Sanders (`79)

vs.

L.C.I.2., Inc., a New Mexico Corporation, defendant-appellee, represented by Paul S. Grand and Josh Harris

Plaintiffs-appellants challenge the granting of summary judgment in favor of the defendant-appellee, stating that they presented evidence that raises a genuine issue of material fact with regards to whether the roof that Bobby Windham fell from was controlled by the defendant-appellee.
