NM Court of Appeals Schedules February 22, 10:00 AM Hearing

COA LogoThe New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Wednesday, February 22, 2018. The oral argument is open to the public and begins at 10:00 A.M.

A three-judge panel will preside: Judge Linda M. Vanzi (’95), Judge M. Monica Zamora (’87), and Judge Henry Bohnhoff.

Following are the details of the case:

PROVISIONAL GOVERNMENT OF SANTA TERESA, AND MARY GONZALEZ, Plaintiff-Appellants, represented by Robert M. White, Randy M. Autio, and Lance D. Hough

THE CITY OF SUNLAND PARK, Intervenor-Respondent, represented by Bradley A. Springer and Holt Mynatt Martinez

Intervenor-Appellee, the City of Sunland Park has attempted to annex the unincorporated community of Santa Teresa since the 1980s. During the same time, Santa Teresa citizens have attempted to create a new municipality. The dispute has come to focus on the rights of citizens in a distinct community within in an urbanized county to retain their independent community status and incorporate to provide a greater level of municipal services versus the desire of a neighboring City to annex the small community. The legal issue at the center of this decades long dispute concerns conflicting interpretations of a statute governing incorporation in urbanized counties.
