NM Court of Appeals Schedules April 22 Hearing

April 2, 2010 - Jen Laws

The New Mexico Court of Appeals has scheduled a hearing at the Court of Appeals Pamela B. Minzner Law Center at 10:00 a.m. April 22. The oral argument is open to the public.

Presiding will be Judge Celia Foy Castillo (`81), Judge Roderick Kennedy and Judge Michael Vigil (`77).

Following are the details of the case:
United Nuclear Corporation, Third-Party Plaintiff-Appellant, represented by Stephen J. Lauer
Vs.
Allstate Insurance Company, Third-Party Defendants- Appellees, represent by Lisa Entress Pullen

This appeal arises out of a case involving multiple parties. For clarity, only those parties involved in the appeal have been listed. The third-party plaintiff-appellant argues that the term “sudden,” in the context of an insurance contract, may mean either “abruptly” or “unexpected,” while third-party defendants-appellees argue that it means only “abruptly” and, therefore, the situation was outside the coverage of the policy.

Third-Party Defendants- Appellees’ Answer Brief
Third-Party Plaintiff-Appellant’s Reply Brief
Travelers Casualty and Surety Company’s Amicus Curiae Brief in support of Appellee
