NM Court of Appeals Schedules Feb. 22 Hearing

The New Mexico Court of Appeals has scheduled a Feb. 22 hearing at the new Court of Appeals Pamela B. Minzner Law Center, adjacent to the UNM School of Law. The oral argument begins at 2 p.m. and is open to the public.

A three-judge panel will preside: Judge Jonathan Sutin (`63), Judge Michael Vigil and Judge Linda Vanzi (`95).

Following are the details of the case:
Horace Bounds, Jr. and Jo Bounds, husband and wife; and the San Lorenzo Community Ditch Association; and intervenor, New Mexico Farm & Livestock Bureau, plaintiffs-appellees, represented by Beverly J. Singleman and Alvin F. Jones (`70)

State of New Mexico and John R. D’Antonio, defendants- appellants, represented by Stacey J. Goodwin (`88)

Defendants-Appellants challenge the District Court’s finding that the Domestic Well Statute, NMSA 1978, §72-12-1.1 (2003), is unconstitutional under the New Mexico Constitution.
