NM Court of Appeals Schedules August 19 Hearing

The New Mexico Court of Appeals has scheduled a hearing for 1:30 p.m. August 19 at the Pamela B. Minzner Law. The oral argument is open to the public.

A three-judge panel will preside: Judge James J. Wechsler, Judge Jonathan B. Sutin (`63) and Judge Michael E. Vigil.

Following are the details of the case:

Cheryl Lee Durham Gordon, Petitioner-Appellee, represented by Patrick L. McDaniel (`97)

vs.

Timothy E. Gordon, Respondent-Appellee, represented by Susan I. Brown

vs.

HSPC, Inc., and De Lage Landen Financial Services, Inc., Intervenors-Appellants, represented by David A. Grammer, III (`79)

and

Nassau Lens Co., Inc., d/b/a Nova Optical Laboratory, Intervenor,

vs.

Zia Trust, Inc., Receiver-Appellee, represented by Kenneth C. Leach (`75)

Intervenors are creditors in a marriage dissolution between petitioner-appellee and respondent-appellee. As third-party beneficiaries, the intervenors seek to have the court liquidate retirement assets to settle the debts of the marital community.
