April 1, 2011 - Jen Laws

The New Mexico Court of Appeals has scheduled a hearing at the Court of Appeals Pamela B. Minzner Law Center at 10 a.m. April 19. The oral argument is open to the public.

Presiding will be Judge Michael Vigil, Judge Robert Robles (`75) and Judge Linda Vanzi (`95).

Following are the details of the case:
City of Rio Rancho, Plaintiff/Counter Defendant-Appellant, represented by Randy S. Bartell
vs.
Cloudview Estates, LLC., Defendant/Counter Claimant-Appelle, represented by J. Douglas Foster

AND

City of Rio Rancho, Plaintiff-Appellant, represented by Randy S. Bartell
vs.
Amrep Southwest Inc., represented by Mathew M. Spangler

This appeal combines two trial cases arising from the same actions: a parcel of land was conveyed to Cloudview Estates by Amrep Southwest Inc, and Cloudview sought to have an easement upon the land parcel vacated. The City of Rio Rancho seeks to have the trial courts’ summary judgment rulings in favor of Cloudview Estates and Amrep Southwest Inc. reversed.
