NM Court of Appeals Schedules November 30 Hearing

The New Mexico Court of Appeals has scheduled a hearing at the McCall Performing Arts Center, Sandia Preparatory School, 532 Osuna Road NE, on Wednesday, November 30, 2011. The oral argument is open to the public and begins at 12:30 pm.

A three-judge panel will preside: Chief Judge Celia Foy Castillo (’81), Judge Michael E. Vigil and Judge J. Miles Hanisee.

Following are the details of the case:

AMERICAN NATIONAL PROPERTY AND CASUALTY COMPANY, Plaintiff/Counter Defendant-Appellant, represented by Paul E. Houston, Brian T. Judson and Jamie R. Kennedy

vs.

TINA CLEVELAND and ADAM HUDSON, Defendants/Counter Plaintiffs-Appellees, represented by Steven L Tucker and James C. Ellis

Appellees’ insurance claim was denied under a “racing” exception to coverage.  The trail court found for the Appellees, that the Appellant had acted in bad faith in denying the claim. Appellant appeals the finding.
