NM Court of Appeals Schedules Afternoon Hearing on May 17

The New Mexico Court of Appeals has scheduled a 1:30 p.m. hearing on May 17 at the Pamela B. Minzner Law Center. The oral argument is open to the public.

A three-judge panel will preside: Judge Jonathan B. Sutin (`63), Judge Roderick Kennedy, and Judge Robert E. Robles (`75).

Following are the details of the case:
Sherri Corum, as prsonal representative of the Wrongful Death Beneficiaries of Mary Jo Herbert, deceased, plaintiff-appellee, represented by Dusti D. Harvey (`96)
vs.
Roswell Senior Living, LLC, et al., defendants-appellants, represented by Thomas C. Bird (`82).

Defendants-Appellants seek the enforcement of an arbitration agreement, while plaintiff-appellee argues that the decedent’s husband had authority to sign for her admittance to the nursing home, he did not have the authority to agree to arbitration.
