NM Court of Appeals Schedules July 23 Hearings

The New Mexico Court of Appeals has scheduled hearings on July 23 at the Pamela B. Minzner Law Center. The first hearing begins at 9 a.m., followed by the second hearing at 10:30 a.m. Both oral arguments are open to the public.

Details of the 9 a.m. hearing are as follows:

A three-judge panel will preside: Judge James J. Wechsler, Judge Michael E. Vigil and Judge Linda M. Vanzi (’95).

Following are the details of the case:

Joey Parkhill and Paula Parkhill, a married couple, in their own behalf and on behalf of their minor children, Victoria and Rebekah Parkhill, Plaintiffs-Appellants, represented by Laurence M. Berlin and Bradley L. Booke

vs.

Alderman-Cave Milling And Grain Company of New Mexico, Defendant-Appellee, represented by John S. Thal (`81)

Appellant seeks to have the testimony from their expert witnesses on health issues from exposure to contaminated feed considered, after the trial court found that the testimony did not meet the standards for admission in Rule 11-702 NMRA and Alberico-Daubert.

Details of the 10:30 a.m. hearing are as follows:

A three-judge panel will preside: Judge Michael D. Bustamante (’74), Judge Michael E. Vigil, and Judge Linda M. Vanzi (’95).

Following are the details of the case:

Connie Lea Gibson Andrews, Individually and as Personal Representative of Tommy Lindell Andrews, deceased, Plaintiff-Appellant, represented by Steven L. Tucker and Lance H. Lubel

vs.

United States Steel Corporation, Chevron USA Inc., Concophillips Company and Raiator Specialty Company, Defendants-Appellees, represented by Rebecca Nichols Johnson.

Plaintiff-appellant states that the trial court incorrectly excluded two of their expert witnesses and that their inclusion would have prevented the court from granting summary judgment to the defendants-appellees.
