NM Court of Appeals Schedules July 20, 2:00 PM Hearing

The New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Wednesday, July 20, 2016. The oral argument is open to the public and begins at 2:00 P.M.

A three-judge panel will preside: Judge Michael E. Vigil, Judge Michael D. Bustamante (’74), and Judge Jonathan B. Sutin (’63).

Plaintiffs Ryan Morgan, Coulton Quevedo, Marc Fleming, and Jordan Almanza were enrolled in Tierra Blanca Ranch High Country Youth Program (TBR). Almanza was placed at TBR by Juvenile Probation and Parole, a division of New Mexico Children, Youth and Families Department. TBR advertises it provides services for children and adolescents who have ADD, RAD, ADHD and other problems or disabilities, as well as children and adolescents who are emotionally, mentally, and physically damaged or sexually abused, and children and adolescents who are suicidal. Plaintiffs-Appellants allege that while residing at TBR, they were subjected to abuse, neglect, and endangerment at the hands of staff members. The appeal arises from the district court’s grant of a Motion for Summary Judgment in November, 2014 in favor of several entities of the State of New Mexico, based on the court’s finding that the State was entitled to immunity from suit.
