NM Court of Appeals Schedules January 24 Hearings

The New Mexico Court of Appeals has scheduled two hearings at the Pamela B. Minzner Law Center on Tuesday, January 24, 2012.

The first hearing begins at 10:00 am and is open to the public.

A three-judge panel will preside: Chief Judge Celia Foy Castillo ('81), Judge Michael D. Bustamante ('74), and Judge Timothy L. Garcia ('84).

Following are the details of the case:

CONCEPCION ACOSTA, et al., Plaintiffs-Appellants, represented by David R. Lira, Martin N. Buchanan, Steven L. Tucker and Michael Newell

vs.

SHELL WESTERN EXPLORATION PRODUCTION, INC., and SHELL OIL COMPANY, Defendants-Appellees, represented by Edward Ricco, Jocelyn Drennan, Marte Lightstone and Michael J. Mazzone.

Appellants challenge the exclusion of their expert witness and that, additionally, juror misconduct, including inappropriate discussion of the case prior to deliberation.

The second hearing begins at 2:00 pm and is open to the public..

A three-judge panel will preside: Chief Judge Celia Foy Castillo ('81), Judge Jonathan B. Sutin (`63), and Judge Michael E. Vigil.

Following are the details of the case:

CITY OF ALBUQUERQUE, Plaintiff-Appellee, represented by Robert D. Kidd, Jr. and John E. DuBois

vs.

PANGAEA CINEMA, LLC, d/b/a GUILD CINEMA, LLC, KEIF HENLEY, Registered Agent, Defendant-Appellant, represented by Laura Schauer Ives

Appellant challenges that finding that the screening of a single adult film is sufficient to designate a business as an "adult amusement establishment."
