COA LogoThe New Mexico Court of Appeals has scheduled a hearing at the Pamela B. Minzner Law Center on Tuesday, April 24, 2018. The oral argument is open to the public and begins at 1:30 P.M.

A three-judge panel will preside: Judge Michael E. Vigil, Judge Henry Bohnhoff, and Judge Emil J. Kiehne.

Following are the details of the case:

JESSICA CRESPIN, Plaintiff-Appellant, represented by Samuel H. Walker

v.

SAFECO INSURANCE CO., OF AMERICA, Defendant-Appellee

And

TRAVIS BAINBRIDGE AND FABIA FIERRO, Defendants, represented by Shannon Parden

This appeal arises from a bench trial tried before the Honorable Nan G. Nash in the Second Judicial District Court in May 2016. The crux of Plaintiff's case was her challenge of Defendant-Appellee's denial of her claim for uninsured motorist coverage benefits under an auto insurance policy purchased by her parents. The issue presented for review is whether an insurance company must provide uninsured motorist coverage to an insured when an uninsured motor vehicle is used as an integral tool in completing a conspiracy to commit a sexual assault against her.
